If and when this actually happens, you can be sure the next bit of news will be:
"ps3 owners banned from psn, consoles bricked"
Unlike the psp, there is no way to build a custom firmware for the ps3, and no way to ever build one. Therefore there is no way to prevent Sony from easily scanning your console and detecting any mod or hack existing on it... that includes any game .iso's on your hard drive, as well as .iso loading devices connected to it.
Maybe you could get away with it if you keep your ps3 off PSN when the loader and drive with .iso's are connected? Not if the firmware is updated to detect them... online or not, you have to use the latest firmware, and the first successful mod or hack will be known by Sony and dealt with in a firmware update by the time you have a chance to have it done... so as soon as the mod is done, the firmware will bust you, next time you're online it will inform Sony of the mod, then delete itself and Sony will send you some nasty letter about how you and your ps3 are forever banned from PSN and firmware use... they also might sue you too.
I wonder if this stuff is what update 2.42 was about? It was such a quick little thing, and it didn't say what it changed... could have something to do with mod detection.
Again, besides Sony being able to send you to denial-of-service hell, piracy tools like .iso loaders are futile for ps3 because there's no custom firmware and no way to make one. It's not a psp, to make a working custom OS you would have to own your own semiconductor factory and design labs, and be able to reverse engineer the chips that control the firmware, including the hypervisor. By the time anyone ever figured it out, the next console generation will have been released and it will be a moot issue - just like open-source, fully-functional drivers for ATI and Nvidia cards are "worked on" but never finished.
Without custom firmware, modding a ps3 is like urinating right in front of a cop. The ps3 firmware is in control, it knows everything your ps3 does, and there's no way around that. Sony knows people are trying anyway, which is why they made it clear in the firmware EULA what's in store for the first successful modder: denial of service and possibly lawsuits.
